Rental terms
Cebu City Rentals
RENTAL TERMS AND CONDITIONS
These terms govern the rental of vehicles. By completing a booking, the Renter agrees to the following:
1. ELIGIBILITY
The Renter must be at least 21 years of age and hold a valid driver's license (Philippine or International). A valid government-issued ID is required at pickup.
2. RENTAL PERIOD
The rental begins at the agreed pickup time and ends at the agreed return time. Late returns are subject to additional charges at the daily rate.
3. FUEL POLICY
Vehicles are provided with a full tank and must be returned with a full tank. Failure to do so will result in a refueling charge plus a service fee.
4. AUTHORIZED DRIVERS
Only the Renter and drivers listed in the rental agreement may operate the vehicle. Unlisted drivers void all coverage.
5. GEOGRAPHIC RESTRICTIONS
The vehicle may only be operated within the Philippines. The vehicle must not be taken to another island unless the Company has given written approval beforehand. This includes any travel by ferry. Taking the vehicle to another island without written approval voids all coverage.
6. COLLISION AND DAMAGE WAIVER (CDW)
Unless the Renter purchases the optional CDW, the Renter is fully liable for all damage to the rental vehicle, including theft, regardless of fault.
If CDW is purchased:
- The Renter's liability for collision damage is reduced to the stated deductible.
- CDW does NOT cover: reckless driving, DUI, off-road use, typhoon/flood damage, tire/rim/undercarriage damage, or theft when keys are left in the vehicle.
- CDW is void if the Renter violates any term of this agreement.
7. THIRD-PARTY LIABILITY
The Company maintains Compulsory Third Party Liability (CTPL) insurance as required by Philippine law. This covers bodily injury to third parties only. Property damage to third parties is the Renter's responsibility unless optional liability coverage is purchased.
8. PERSONAL ACCIDENT INSURANCE (PAI)
PAI covering the driver and passengers may be purchased as an optional add-on. Benefits include accidental death, permanent disablement, and medical expense reimbursement as specified in the policy.
9. PROHIBITED USES
The vehicle must not be used for: illegal activity, transporting hazardous materials, racing, off-road driving, sub-letting to another party, or towing without prior written consent.
10. TRAFFIC VIOLATIONS
The Renter is responsible for all traffic violations, fines, and penalties incurred during the rental period.
11. ACCIDENTS AND INCIDENTS
In the event of an accident, the Renter must: (a) not admit liability; (b) obtain details of all parties involved; (c) photograph the scene; (d) obtain a police report; (e) notify the Company immediately. Failure to follow this procedure may void applicable coverage.
12. BREAKDOWN AND ROAD ASSISTANCE
Contact the Company immediately in the event of a breakdown. The Company will arrange roadside assistance. Do not authorize repairs without prior Company approval.
13. MOTORCYCLES AND SCOOTERS (ADDITIONAL TERMS)
- The Renter must hold a valid motorcycle license (restriction code 1 or appropriate).
- Helmet use is mandatory for all riders at all times.
- Standard CDW does not apply to two-wheeled vehicles unless specifically stated.
- Night riding (10 PM – 5 AM) may void coverage.
14. RETURN CONDITION
The vehicle must be returned in the same condition as received. The Renter is liable for any damage noted at return that was not present at pickup.
15. SECURITY DEPOSIT
A refundable security deposit is required at pickup. It secures the return of the vehicle in the same good condition as at pickup. The amount depends on the vehicle and is shown in the booking. The deposit may be paid in cash or held on a credit card. The deposit, or the card hold, is released after the vehicle is returned and checked, as long as there is no damage, no missing items, and no unpaid charges. Any amount the Renter owes may be taken from the deposit.
16. MILEAGE
Mileage is unlimited, unless the booking states a limit. If the booking states a limit, any distance driven over that limit is charged at the rate shown in the booking.
17. CANCELLATION AND NO-SHOW
The Renter may cancel a booking for free up to 24 hours before the rental start time. A cancellation made less than 24 hours before the rental start time, or a no-show (the Renter does not arrive at the agreed pickup time), is subject to a cancellation fee of PHP 1000.
18. SUBSTITUTION AND REPOSSESSION
The Company may provide a similar vehicle in place of the one booked if the booked vehicle is not available. If the Renter breaks any term of this agreement, the Company may take back the vehicle at any time, without notice, and end the rental.
19. DAMAGE-RELATED CHARGES
When the vehicle is damaged and the Renter is liable, the following charges apply on top of the cost of repair:
- An administrative handling fee of 5% of the repair cost, for processing the damage claim.
- A loss-of-use charge for each day the vehicle cannot be rented out while it is being repaired, charged at the vehicle's daily rental rate.
20. LOST KEY
If a key is lost, the Renter must pay the full cost of a replacement key from the vehicle manufacturer.
21. NO SMOKING
Smoking is not allowed inside the vehicle at any time. If the vehicle is returned smelling of smoke, a cleaning charge of PHP 2,000 applies and may be deducted from the security deposit.
22. PERSONAL BELONGINGS
The Company is not responsible for any personal belongings left in the vehicle, during the rental or after the vehicle is returned. The Renter must remove all personal items before returning the vehicle.
23. VEHICLE CARE ON LONG TRIPS
On long trips, the Renter should regularly check the engine oil, the coolant level, and the tire pressure. If a warning light comes on, the Renter must stop and contact the Company before driving further.
24. REFUSAL TO HAND OVER THE VEHICLE
The Company may refuse to hand over the vehicle at pickup if the Renter or the driver:
- appears to be drunk or under the influence of drugs;
- cannot show a valid driver's license or a valid government-issued ID;
- shows a license that has expired or does not cover the vehicle type;
- is not the person named in the booking, or is a driver who was not listed and approved; or
- refuses to pay the rental fee or the security deposit.
In this case, the Company may treat the booking as a no-show under clause 17.
25. FORCE MAJEURE
The Company is not liable if it cannot provide the vehicle, or cannot meet its obligations under this agreement, because of events outside its reasonable control. This includes typhoons, floods, earthquakes, fire, accidents, theft, road closures, government orders, power or network failures, and similar events. If such an event prevents the rental from starting, the Company will refund any amount already paid for that rental.
26. GOVERNING LAW
These terms are governed by the laws of the Republic of the Philippines.
27. DISPUTE RESOLUTION
The parties will first try to settle any disagreement in good faith. If they cannot, the dispute will be handled only by the proper courts of Cebu, Philippines, to the exclusion of any other court.
